O R D E R

This Criminal Original Petition has been filed to direct the respondent to produce the body or the person of the petitioner's husband Kattandi, son of Krishnan, an employee of Chennai Port Trust, before this Hon'ble Court and set him at liberty.

2.Heard the learned counsel for the petitioner and the learned Government Advocate (Criminal Side) appearing on behalf of the respondents.

3.On perusal of the materials and on consideration of the submissions made by the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) appearing on behalf of the respondents, it is seen that the husband of the petitioner has developed illicit intimacy with one Radha and eloped with her.

4.This issue which cannot be resolved by the police and the parties will have to workout their remedy only before the appropriate Court. Neither this Court nor the police can compel the husband of the petitioner to live with the petitioner and this is not the proper forum to adjudicate the dispute.

5. This Criminal Original Petition is disposed of by giving liberty to the petitioner workout her remedy before the appropriate Court in accordance with law.
