ORDER
(Order of the Court was made by G.Jayachandran J.) The petitioner herein has made a representation to the 2nd respondent seeking issuance of Community certificate, as she belongs to Jambuvulu (Scheduled caste) community. The said application was allegedly submitted on 23.01.2025. Since no action was taken on the application, despite her father being the origin of Puducherry and belonging to Jambuvulu (SC) community, the petitioner earlier approached this Court by way of Writ Petition No.24820 of 2025, seeking mandamus directing the 2nd respondent to consider the representation and issue the Community Certificate.
2. Pursuant to the direction of this Court, the Tahsildar, Taluk Office, Yanam, communicated to the Learned Counsel who appeared on behalf of the petitioner, through letter dated 12.08.2025 that the petitioner is not eligible to obtain Jambuvulu Scheduled Caste community (origin) under the Constitution (Pondicherry) Scheduled Castes Order, 1964, based solely on her mother's status. The said communication is now under challenge by way of certiorarified mandamus. One of the grounds raised in the affidavit is non-application of Page Nos.2/5
mind and failure to afford opportunity of personal hearing.
3. The Learned Additional Government Pleader representing the 2nd respondent submitted that the 2nd respondent will consider the representation afresh and pass orders after affording opportunity of hearing.
4. Taking into consideration the said submission, we dispose of the writ petition with the following direction:
The writ petitioner shall file afresh application along with all necessary documents to show her parents are origin of Puducherry. On receipt of such application and after affording personal hearing, the 2nd respondent shall consider and pass appropriate order on merits and in accordance with law, within a period of four weeks from the date of receipt of the representation. There shall be no order as to costs.
