PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the 4th respondent to conduct an enquiry by giving affordable opportunity to all the parties concerned based on the representation dated 23.05.2023 and consequently direct them to take action to restore the S.No.89 as Meikal Purampokku and S.No.87/1 as Odai Purampokku Situated in Karandhai Village Venbakkam Taluk Tiruvannamalai district as per their own existing revenue record of the 4th respondent.

The petitioner herein seeks a direction to 4th respondent to conduct enquiry on the representation submitted on 23.05.2023 and consequently, direct the respondents to restore the Survey No.89 in Karandhai Village Venbakkam Taluk Tiruvannamalai district as "Meikal Purampokku" in the revenue records.

2. According to the petitioner, the Survey No.89 is classified as a raising land (Meikal Purampokku) in the A-Register of the village and the same was occupied by 5th respondent illegally and he also obtained patta in respect of 2/5

portion of the land in Survey No.89 by making misrepresentation. Therefore, the petitioner submitted a representation to the 4th respondent on 23.05.2023 seeking necessary action for restoration of classification as "Meikal Purampokku" in the revenue records. The said representation has not been considered. Aggrieved by the same, the petitioner is before this Court by way of writ petition.

3. Mr.A.Selvendran, learned Special Government Pleader takes notice for the respondents 1 to 4.

Though this Court is not inclined to issue any positive direction in favour of the petitioner, in view of the grievance expressed by the petitioner with regard to the classification in the case on hand, this Court is inclined to issue a direction to 2nd respondent to consider the representation of the petitioner dated 23.05.2023 and pass final orders on merits after affording necessary opportunity to the petitioner as well as 5th respondent within a period of eight weeks from the date of receipt of copy of this order. 3/5
