ORDER
This Writ Petition has been filed seeking a direction to the 3rd respondent to issue Patta in respect of the subject property which is in possession of the petitioners.
2. It is the case of the petitioners that they are dwelling in the Government Pormboke land, which is the subject property of this Writ 2/6
Petition and they are in possession of the same for the past 40 years on payment of certain taxes to the Government. Time and again, various Government Orders came to be passed to safeguard the interest of the dwellers in the Government Poromboke lands by issuing Patta in favour of them. The petitioners, having been covered under the said G.Os issued by the Government, in order to avail the benefit under the G.Os, they made a representation dated 12.11.2014 before the respondents seeking to grant patta in their favour. However, till date, the same has not been considered, which resulted in filing of the present petition.
3. Learned counsel for the petitioners submitted that the petitioners may be permitted to make a fresh representation before the Revenue Authorities seeking to issue Patta in favour of the petitioners in respect of the subject lands and the said representation may be considered in the light of the Government Orders issued by the Government within the time that may be stipulated by this Court.
4. On the above contentions, heard the Special Government Pleader 3/6
appearing for the respondents 1 to 3.
5. In view of the limited relief sought for by the petitioner, this Court, without expressing any opinion on the merits of the case, permits the petitioner to make a fresh representation for issuance of Patta before the 2nd Respondent/Tahsildar within a period of two weeks from the date of receipt of a copy of this order. On such representation being made, the 2nd respondent is directed to consider the said representation in accordance with law and pass appropriate orders on the same, after affording an opportunity of personal hearing to the petitioner as well as to the aggrieved persons if any as expeditiously as possible.
6. Accordingly, this Writ Petition is disposed of with the aforesaid direction. No Costs. Consequently, the connected Miscellaneous Petition is closed.
