J U D G M E N T
This suit has been filed for directing the defendants to execute and register the sale deed in favour of the plaintiff after receiving the balance sale consideration Rs.50 Lakhs pertaining to the schedule mentioned property and handover vacant possession to the plaintiff and for permanent injunction restraining the defendants and their men from in any way encumbering the plaint schedule property and for cost.
2. The plaintiffs and the defendants are present and filed memo of compromise. The parties also admitted before this Court that they have entered into a compromise and a decree may be passed in terms of the compromise.
3. In view of the compromise entered into between the parties, this suit is decreed in terms of the memo of compromise entered into between the parties and the sale consideration
deposited into the credit of the suit shall paid as per the compromise memo and a cheque shall be issued in the name of the defendant and after such payment, the defendant shall execute the sale deed. The memo of compromise shall form part of the decree. Considering the relationship between the parties, there shall be no Order as to costs. Consequently, the connected original application is closed.
