Respondents Writ Petition filed under Article 226 of the Constitution of India seeking issuance of a Writ of Mandamus directing the respondents 1 to 4 to sub-divide the land of the petitioner measuring an extent of 1468 Sq Meter which is acquired out of 23,544 sq.ft. situated at plot No.E-2 comprised in S.No.643/15, 1A4B situated at Mannur Village Sriperumbuthur Taluk, Kancheepuram District.

This writ petition has been filed seeking issuance of a writ of mandamus directing the respondents to act upon the representation made by the petitioners wherein the petitioners are seeking for sub-division of the property and for demarcation of boundaries after conducting the survey.

2. Heard Ms.S.Hemalatha, learned counsel for petitioner and Mr.A.Selvendran, learned Special Government Pleader appearing for respondents.
3. The case of the petitioners is that they were owners of the property measuring total extent of 23544 sq.ft. A portion of the property was acquired and they are left with 7420 sq.ft. The petitioners are seeking for survey of the property for sub-division and for demarcation of boundaries since attempts are being made to encroach upon the remaining property belonging to the petitioners. Since the same was not acted upon, the present writ petition has been filed before this Court.
4. Taking into consideration the facts and circumstances of the case and the materials placed before this Court, there shall be a direction to the fourth respondent to conduct the survey in the subject property in the presence of officials of the Tamil Nadu Road Development Corporation and also in the presence of the fifth respondent and the remaining property belonging to the petitioners shall be ascertained and the boundaries shall be demarcated and thereafter, sub-division shall be made. The survey shall be completed within a period of four (4) weeks 3/4

The process of subdivision and issuance of patta for the sub-divided property shall be done within a period of eight (8) weeks thereafter. This writ petition is disposed of with the above direction.
