This petition has been filed by the petitioner to clarify the order passed by this Court in CRP(PD).No.1010 of 2023 dated 17.11.2023.
2. The learned counsel for the petitioner brought to the notice of this Court that the 3rd and 4th paragraphs of the order passed by this Court in CRP(PD).No.1010 of 2023 dated 17.11.2023 to be read as follows: ...........
"3. Considering the submissions of both sides, both parties are entitled to put forth their contentions with regard to the issue involved in this petition before the Tribunal and to cooperate with the proceedings. Hence, the Tribunal is directed to give opportunity to the parties and adjudicate the issue as early as possible and finally, along with other issues which may be framed during the course of Arbitration without being influenced by the order dated 30.01.2023 passed under Section 16 of the Arbitration Act, by the Learned Arbitrator. 4. Accordingly, the impugned order passed by the learned Arbitration in I.A.No.1 of 2022 in Arb.O.P.(Comm.Div.) No.210 of 2022 is set side. In view of the above, this Civil Revision Petition is disposed of. "
3. Registry is directed to substitute the above paragraphs in the order of this Court in CRP(PD).No.1010 of 2023 dated 17.11.2023, in place of paragraph Nos.3 & 4, and issue a fresh order copy to the parties forthwith.
4. In other respects, the order dated 17.11.2023 shall remain unaltered.
5. With the above direction, this Criminal Miscellaneous petition is ordered.
