O R D E R
This Habeas Corpus Petition has been filed seeking to direct the respondents to produce the detenu by name Jeba Deva Kirubai, aged about 24 years, before this Court and hand over her custody to the petitioner.
2.The petitioner is the father of the detenue. According to him, his daughter, the detenu herein, was married to the 3rd respondent herein, as early as on 13.9.2010 and a female child was born to them out of the said wedlock. Due to some dispute between the couple, the detenue came to the parental home and has been living with the petitioner for the past one year. As the detenue is a B.Sc. Nursing graduate, she has been working in a private nursing home. Whileso, the detenue, who had gone for https://hcservices.ecourts.gov.in/hcservices/
work on 6.8.2013, did not return back home. In this connection, he has given a complaint before the respondent-Police and the same was registered in Crime No.1379/2013. As there is no progress in the matter, the present petition has been filed.
3. The respondent-Police has filed a status reports dated 27.1.2015 explaining the steps that have been taken by them in tracing the detenue. Admittedly, a case has been registered in Crime No.1379/2013 as 'woman missing'. It is further stated that a special team has been formed to trace the detenue. The said team had visited various places and made enquiries regarding the whereabouts of the detenue. Though no clue has been obtained in the enquiry, the respondent-Police are continuing with their investigation.
4. In these circumstances, as effective steps are taken by the respondent-Police to trace the detenue, no further orders are necessary and the Habeas Corpus Petition stands closed. However, we make it clear that the respondent-Police shall continue with the investigation and take necessary and effective steps to trace the detenue, as expeditiously as possible.
