This Criminal Revision Case is filed under Section 397 & 401 of Criminal Procedure Code against the order passed in C.M.P.No. 1271 of 2008 by the Learned Judicial Magistrate of Ootacamund, The Nilgris on 24.10.2009 allowing the condone delay petition and prays to set aside the same.

This Criminal Revision is preferred against the order dated 24.10.2009 passed by learned Judicial Magistrate of Ootacamund, The Nilgris in C.M.P.No.1271 of 2008 allowing the petition seeking condonation of delay in filing a case under Section 138 of the Negotiable Instruments Act.

2. The contention of learned counsel for petitioner that an enormous delay of 1007 days in representing the complaint, which was allowed by the Court below is erroneous, does not appeal to us in the least, when it is not informed that the Court below had informed any specific period for representation.

3. Finding that the present revision petition has been pending from the year 2009, this Court dismisses the revision petition. Court below is directed to dispose of the case without fail, within a period of two months from the date of receipt of a copy of this order.
