..Respondents Writ Petition is filed under Article 226 of the Constitution of India, praying for the issuance of a Writ of Mandamus, directing the respondents to pay a sum of Rs.58,800/- withheld by the respondents with 18% interest per annum. For Petitioner -Mr.R.Singaravelan, Senior Counsel for Ms.M.Srividhya.

For Respondents-Mr.A.Raja Perumal, Additional Government Pleader.

ORDER

The relief sought for in this writ petition is for a direction to direct the respondents to pay a sum of Rs.58,800/- withheld by the respondents with 18% interest per annum.

2. The learned Senior Counsel, appearing on behalf of the writ petitioner, states that no doubt an audit objection was raised in respect of the said amount. However, the audit objection was ratified and subsequently, the same was dropped. Even after ratification, the case of the writ petitioner has not been considered for settling the said amount of Rs.58,800/-. In this regard, the writ petitioner made a representation to the first respondent on 3.4.2010 and the same is yet to be considered.

3. Thus, without going into the merits of the matter, the first respondent is directed to consider the representation submitted by the writ petitioner on 3.4.2010 and pass orders on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order. The writ petitioner is directed to enclose the copy of the representation along with the order passed in this writ petition.

4. Accordingly, the writ petition stands disposed of. However, there shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
