B.Ganesan v. V.S.Dhandapani
C.M.P.No.8762 of 2022 in A.S.No.242 of 2022 M.DURAISWAMY, J.
and SUNDER MOHAN, J.
(Order of the Court was made by M.Duraiswamy, J.) The petitioner/appellant has filed the above petition seeking for an order of interim injunction restraining the respondents from in any way dealing with or encumbering or alienating the suit property till the disposal of the appeal.
2.The learned counsel for the petitioner fairly admitted that the petitioner/ appellant did not have the benefit of interim order during the pendency of the suit in O.S.No.3 of 2014 on the file Principal District Court, Thiruvannamalai.
3.Since the suit filed by the appellant seeking for specific performance has been dismissed by the trial Court and that he did not have the benefit of interim injunction during the pendency of the suit, we are not inclined to grant an order of interim injunction. Accordingly, the petition is dismissed.
