ORDER
This Writ Petition has been filed seeking for a Writ of Mandamus, 1/5
to direct respondents to consider the petitioner's representation dated 23.01.2023 within the time frame fixed by this Court.
2. It is the case of the petitioner that her father was given an allotment of "Lease cum Sale" for the Plot No.93 situated at Korattur Village, Tiruvallur District in the year March 1996 from the Tamil Nadu Slum Clearance Board (TNSCB). Subsequently, petitioner's father executed a will in respect of the above said property in favour of the petitioner. Since the said property stands in the name of the petitioner's father even after his death, the petitioner made a detailed representation dated 23.01.2023, before the respondents seeking for issuance of sale deed in favour of the petitioner. Since the same was not considered, the present writ petition was filed.
3. Though very many grounds have been raised in the writ petition, it would suffice if this Court issues a direction to the respondents to consider the petitioner's representation dated 23.01.2023 and pass appropriate orders within the time frame that may be fixed by this Court.
4. Learned standing counsel appearing for the respondents 2/5
submitted that the petitioner's representation dated 23.01.2023 will be considered and appropriate orders will be passed after affording an opportunity of hearing to all the legal heirs of the petitioner's father.
5. Heard learned counsel appearing on either side and perused the materials placed before this Court.
6. In view of the fair submission made by the learned standing counsel appearing for the respondents this Court, directs the respondents to consider the petitioner's representation dated 23.01.2023 and pass appropriate orders on merits and in accordance with law after affording an opportunity of hearing to the petitioner as well as the legal heirs of petitioner's father within a period of six weeks from the date of receipt of a copy of this order.
7. Accordingly, this writ petition is disposed of. No costs. 31.03.2023 Index : Yes / No Speaking order / Nonspeaking order (rap) 3/5
