ORDER
The writ petition is filed for the below relief: "directing the Respondents to disburse the earned leave calculated at the rate of 32 days per year from 01.01.1990 till the date of petitioners husbands retirement along with 90 days private Affairs leave together with interest @ 18 percent P.A. for the delayed period from 31.07.2015 till the date of payment at the earliest".
2. The brief facts which are culminated in the filing of this writ petition are set out below:
2.1. It is the case of the petitioner that the petitioner's late husband was working as Special Grade Senior Factory Assistant in the year 2015 and retired from service. The respondents has not settled her husband's earned leave encashment and private affairs leave encashment benefits. Therefore, the petitioner made a representation to the respondents requesting the payment for her late husband along with the interest for the belated payment. Since there is no response, the petitioner is before this Court.
3. Heard the learned Counsel on either side and perused the materials available on records.
4. Admittedly, the earned leave encashment and private affairs leave encashment benefits has not been paid for no fault of the petitioner and her late husband. Therefore, the petitioner is entitled to interest on the same. Therefore, the Writ petition is allowed as prayed for and a mandamus is issued directing the respondents to disburse the amount due under the head earned leave and private Affairs leave encashment together with interest @ 6 percent P.A. for the delayed period from 31.07.2015 till the date of payment within a period of twelve (12) weeks from the date of receipt of a copy of this order.
