The learned Counsel for the petitioner submitted that the S.C.No.323 of 2009 was acquitted by the learned Principal Sessions Judge, Salem on 24.05.2017. Hence, nothing survives in this case and he may be permitted to withdraw the Criminal Original Petition and he has also made an endorsement to that effect.
