[RESPONDENTS] Writ petition is filed under Article 226 of the Constitution of India praying for a writ of certiorarified mandamus to to call for the records pertaining to the impugned order passed by the 2nd respondent dt 15.6.2015 in PU: R/Estt/R6/012780/2015-8 and quash the same and directing the respondents to retain the petitioner herein as Assistant at the office of the 1st respondent and confer all the benefits which was interrupted on account of transfer order. With the consent of the learned counsel appearing on either side, the Writ Petition is taken up for final disposal at the admission stage itself.
2.The learned counsel appearing for the petitioner submits that the petitioner is a handicapped person and he has three children and they are studying at Salem and by the impugned order, the petitioner has been transferred from Periyar University to Periyar University Constituent Arts College. Hence, the petitioner has come forward with this Writ Petition for quashing the impugned order of transfer. https://hcservices.ecourts.gov.in/hcservices/
3.Though such a positive direction could not be given, taking into consideration the fact that the petitioner is a handicapped person and whose children are studying at Salem, the petitioner is directed to make a representation immediately to the second respondent explaining the aforesaid facts and to recall the order of transfer to Periyar University, which is said to be the far off place from Salem. On receipt of such representation, the second respondent is directed to consider the same in the light of the aforesaid facts and pass appropriate orders within a period of three weeks from the date of receipt of the representation submitted by the petitioner. The Writ Petition is disposed of accordingly. No costs. Consequently, connected Miscellaneous Petitions are closed.
