PRAYER: The Writ Petition has been filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, to direct the first respondent to reinstate the petitioner on the basis of the proposal submitted by the second respondent in letter No.e/f/vz;/1165/2020/rp1, dated 24.12.2020 within a stipulated time.

O R D E R

The present Writ Petition has been filed for the issuance of a Writ of Mandamus directing the first respondent to reinstate the petitioner on the basis of the proposal submitted by the second respondent in letter No.e/f/vz;/1165/2020/rp1, dated 24.12.2020 within a stipulated time that may be fixed by this Court.

2. Heard the learned counsel appearing for the parties. https://hcservices.ecourts.gov.in/hcservices/

3. The petitioner is kept under suspension from 08.02.2020 and thereafter, he made a representation on 09.02.2020 for revoking the suspension. The said representation was forwarded by the second respondent on 24.12.2020 to the first respondent and the same is still pending under consideration of the first respondent. The petitioner seeks disposal of the representation for revoking the suspension.

4. Considering the fact that the representation made by the petitioner dated 09.12.2020 has been forwarded by the second respondent on 24.12.2020 to the first respondent for consideration, without expressing any opinion on merits, a direction is given to the first respondent to consider the representation of the petitioner on merits and in accordance with law and pass orders within a period of four (4) weeks from the date of receipt of a copy of this order.

With the above direction, the Writ Petition is disposed of. There shall be no order as to costs.
