The learned counsel for the petitioner seeks the permission of the court to withdraw the transfer civil miscellaneous petition with liberty to file a fresh petition if the HMOP, which is sought to be transferred, is found to be pending or the same is restored after setting aside the order granted therein.

2. The endorsement is recorded. The Transfer Civil Miscellaneous Petition is dismissed as withdrawn. The liberty sought for is granted. However, there shall be no order as to cost. Consequently, the connected miscellaneous petition is closed.
