This Petition has been filed seeking to condone the delay of 41 days in filing the above captioned C.M.A.

2.Learned counsel appearing for the petitioners/appellants would submit that the 1st respondent remained ex-parte and he has made an endorsement to dispense with the notice to the 1st respondent. 3.Mr.P.Suresh Srinivasan, learned counsel appeared on behalf of the 2nd respondent and submitted that he has no objection in allowing the present petition. 4.Heard the learned counsel appearing for the petitioners and the 2nd respondent/Insurance Company.

5.Considering the averments made in the affidavit filed in support of this petition and also the fact that 2nd respondent has no objection in allowing the present petition, and being satisfied with the same, the delay is condoned. Hence, this petition is ordered as prayed for.
