This writ petition has been filed seeking issuance of Writ of Mandamus Mandamus directing the 2nd and 3rd respondents to make an enquiry relying upon the fraudulent documents executed by the fourth respondent and to prosecute according to the Section 83 of Registration Act, 1908 within stipulated period fixed by this Court. 2.The learned counsel appearing for the petitioner submitted that though the petitioner has filed this writ petition seeking direction to the respondents to cancel the document executed by the fourth respondent, this Court, without going into the merits of the case, may 2/4
grant liberty to the petitioner to approach the competent civil Court for appropriate remedy.
3.Considering the limited relief now sought for by the learned counsel appearing for the petitioner, this Court, without going into the merits of the case, grants liberty to the petitioner to approach the competent civil Court for appropriate remedy. The period during which the writ petition was pending before this Court is excluded for the purpose of limitation.
