Respondent(s) PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus direct the 3rd respondent to dispose-off the petitioner appeal filed against the Refusal Check Slip Dt.15/07/2024 vide Refusal No.RFL/1 Joint Registrar Thiruvallur/85/2024 issued by the 4th respondent and inrespect of Sale Deed Dt.26.07.2024 presented in respect of land comprised in Nanja Land in S.No.958 measuring 0.56.00 Hectare (1 acre 38 cents) situated at Ekkadu Kandigai village,Tiruvellore Taluk and District. 1/4

ORDER
By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself.
2. The present writ petition is filed praying for a writ of mandamus to direct the of 3rd respondent to dispose of the appeal filed by the petitioner against the refusal check slip dated 15.07.2024.
3. It is submitted by the learned counsel for petitioner that against the above refusal slip dated 15.7.2024, an appeal was preferred before the 3rd respondent and the same is stated to be pending.
4. On this being point out, Mr.U.Baranidharan, learned Special Government Pleader for respondents would submit that the above appeal would be considered and orders passed within a period of 12 weeks from the date of receipt of a copy of this order. He would also submit that the appellate authority 2/4
would also have the liberty to examine the maintainability or otherwise of the appeal. It is further submitted that the Wakf Board was also made a party in the appeal.
5. In view thereof, the writ petition is disposed of with a direction to the respondents to consider and dispose of the appeal filed by the petitioner in accordance with law, after affording reasonable opportunity of hearing to the petitioner and any other interested persons/stake holders. The appellate authority shall also hear the Wakf Board before passing any orders. This Court is not inclined to express any opinion on the merits of the matter and all rights and contentions of either parties are left open.
