This petition is filed to dispense with the filing of original order dated 03.02.2023 passed in I.A.No.1 of 2023 in KB S JC.No.265 of 2023 on the file of the sole Arbitrator.

2. I have gone through the affidavit filed in support of the petition and it is seen from paragraph No.5 of the affidavit that the petitioner was not served with notice regarding the appointment of Arbitrator, appointment of Receiver or interim order passed in I.A.No.1 of 2023. According to the petitioner, the only notice that he received in the proceeding is the one sent by Garnishee dated 03.03.2023. For the said reasons, the petitioner has filed this petition to dispense with production of original order and he undertakes to file the original order which he has applied for immediately after receiving the same from the Arbitrator.

In view of the said averments made in paragraph No.5 and the submissions of the learned counsel, the petition to dispense with production of original order dated 03.02.2023 passed in I.A.No.1 of 2023 is dispensed with for the present.
