Writ Petition filed under Article 226 of the Constitution of India seeking issuance of a Writ of Mandamus directing the 2nd and 3rd respondents to consider the petitioner's application challan No.2025/0123/08/007660 dated 05.02.2025 and to survey the petitioner's land in Survey No.208/6A2 measuring an extent of 0.1.62 Ares in Patta No.2746 respectively situated at 041-puthur Agraharam Village, Salem West Taluk, Salem District and to fix its boundaries as per the sale deed Doc No.3644/2021 dated 27.09.2021 within the period that may be stipulated by this Court.

This writ petition has been filed seeking issuance of a writ of mandamus directing the respondents 2 and 3 to deal with the online application submitted by the petitioner on 05.02.2025 and to survey the subject property and to demarcate the boundaries.

2. Heard Mr.A.Arun Kumar, learned counsel for petitioner and Mr.M.R.Gokulkrishnan, learned Additional Government Pleader appearing for respondents 1 to 3.

3. The petitioner is placing reliance upon the sale deed dated 27.09.2021 registered as document No.3644/2021 and also the patta issued in Patta No.2746. The petitioner submitted an application after paying necessary charges for conducting survey in the subject property and for fixing the boundaries. Since the same was not acted upon, the present writ petition has been filed before this Court.

4. Taking into consideration the facts and circumstances of the case and the materials placed before this Court, there shall be a direction to the respondents 2 and 3 to survey the subject property based on the title document and the patta that stands in the name of the petitioner and complete the process within a period of four (4) weeks from the date of receipt of a copy of this order. If there are any rival claims, such survey shall be conducted in their presence.

This writ petition is disposed of with the above direction. No costs.
