Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus directing the first respondent herein to forthwith commence conciliation proceedings on the industrial dispute raised by the petitioner union on 29.05.2020 against the second respondent management's notice of change issued on 22.05.2020 under Section 9A of the Industrial Disputes Act.

ORDER

With the consent of both the parties, this writ petition is taken up for final disposal.

2. The learned counsel for the second respondent seeks permission of this Court to withdraw the memo dated 08.10.2021. https://hcservices.ecourts.gov.in/hcservices/

The permission sought for is granted.

3. The issue in the present writ petition revolves around the change in the service conditions of the workers of the second respondent company, which resulted in an Industrial Dispute.

4. It is now brought to the notice of this Court that the change in the shift timings, which was the dispute, had now been reverted back to the original timings. As such, the petitioner union may not have any further grievance.

5. In view of the subsequent decision to revert the original shift timings, the prayer sought for in the present writ petition also has become infructuous. Accordingly, the writ petition stands closed. No costs. Consequently, connected miscellaneous petition is closed.
