For petitioner : Mr.K.Shyam Sunder (In both W.Ps) For Respondents : Mr.Yogesh Kannadasan (In both W.Ps) Special Government Pleader COMMON ORDER The petitioners have filed this petition seeking direction to the respondents to register the order of the Lok Adalath (LAC No.219/2018) organized by District Legal Services Authority, Ariyalur dated 14.09.2018.
2. Mr.Yogesh Kannadasan, learned Special Government Pleader takes notice for the respondents. In view of the limited relief sought for in this petition and on the consent expressed by the learned counsel appearing on either side, this petition is taken up for final disposal.
3. The case of the petitioner is that, the first petitioner herein had filed a suit in O.S.No.3 of 2016, before the IIAdditional District Judge, Ariyalur, praying for partition of the said properties in the suit. However, during the pendency of the suit, it was referred to Lok Adalath and the dispute was settled in between the parties, and an Award was passed on 14.09.2018. Thereafter, the petitioner is inclined to register the said Lok Adalath Award and submitted a document before the second respondent. However, the second respondent had refused to register the documents presented by the petitioners. Challenging the same, the present Writ Petition has been filed by the petitioner for the above relief.
4. Though very many grounds have been raised, learned counsel for the petitioner submits that it would suffice if this Court directs the second respondent to entertain the document presented by the petitioners dated 14.09.2018 within the time frame that may be fixed by this Court.
5. The learned Special Government Pleader appearing for the respondents submits that the documents presented by the petitioners dated 14.09.2018 will be entertained by the second respondent within the time frame that may be fixed by this Court.
6. In view of the aforesaid submissions, this Court without expressing any opinion on the merits of the case, permits the petitioners to present the Lok Adalath Award dated 14.09.2018 for registration within a period of two weeks from the date of receipt of a copy of this order, if such a document is received the second respondent is directed to entertain the same, if it is otherwise in order, and pass appropriate orders within a period of twelve weeks from the date of receipt of document, after collecting the necessary stamp duty and registration charges from the petitioners.
7. Accordingly, this writ petition is disposed of with the aforesaid direction. No costs.
