Anaicut Taluk, Vellore District.

O R D E R

This petition has been filed seeking a direction to respondents 1 to 3 to consider the petitioner's representation dated 14.05.2024 and consequently direct the third respondent to provide adequate police protection to enable the petitioner to put up a fence around his land comprised in Survey Nos. 210/7A and 210/7B, situated at Sembedu Village, Anaicut Taluk, Vellore District.

The case of the prosecution is that the petitioner is the rightful owner of 60 cents of land comprised in Survey No. 210, subdivided into 210/7A and 210/7B, situated in Sembedu Village, Anaicut Taluk, Vellore District, inherited through valid sale deeds and Patta No. 209. While being so, when the petitioner attempted to fence the land, the adjacent

landowner, who is the fourth respondent herein, along with his sons, namely, Vinoth Kumar and Vignesh, interfered with the petitioner's fencing work, subjected the petitioner and his family to verbal abuse and threatened them with dire consequences. Despite multiple complaints and a direction from this Court in Crl.O.P. No. 11665 of 2023 dated 03.11.2023, the threats continued. On 10.05.2024, the accused again threatened and attempted to assault the petitioner. A representation dated 14.05.2024 was made to the higher authorities seeking police protection, but no steps were taken. Therefore, the petitioner prays for a direction to the respondents 1 to 3 to provide protection for fencing the property and ensure safety from the accused.

2. Heard both sides and perused the material available on record.

3. Considering the facts and circumstances of the case, this Court is of the view that police protection can only be granted to safeguard the life and limb of a person. If there is any obstacle or objection while erecting a fence around the petitioner's property, the petitioner may approach the Civil Court for appropriate relief.
