Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India seeking Writ of Mandamus directing the respondents to revise the petitioner's wages with effect 01.09.2016 based on the 13th wage settlement dated 04.01.2018 and pay him the difference in Gratuity and leave liability along with the interest at the rate of 12% per annum from the date of entitlement to till the date of actual disbursement within a time limit to be stipulated by this Court.

ORDER

The writ petition has been filed in the nature of a mandamus seeking benefit of the wage settlement dated 04.01.2018 entered into under section 12(3) of the Industrial Disputes Act, 1947, commonly referred to as Section 13the wage settlement to be afforded to the petitioner also.

2. It is contended that the petitioner had retired from service on attaining the age of superintendent on 31.07.2017. Therefore, he claimed that the benefit of the settlement entered into on 04.01.2018 should also be paid to him. The respondents may examine whether the petitioner is eligible for such benefit to be paid and if he is eligible pay the said amount to him. The petitioner is also entitled for interest at the rate of 6% per annum from the date of settlement till the date of disbursement. The entire exercise must be completed within a period of four months from the date of receipt of a copy of this order.

4. The writ petition stands disposed of. There shall be no order as to costs.
