PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of Writ of Mandamus, directing the first respondent to provide adequate police protection while surveying the property comprised in SNo.105/6B1 measuring to an extent of 0.20.0 hectares and SNo.105/5D2 measuring to an extent of 0.10.0 hectares situated at Thorapalli village, Shoolagiri Taluk, Krishnagiri district by considering the petitioner's representation dated 01.02.2025 within a stipulated period.

ORDER

This Writ Petition has been filed for direction directing the first respondent to provide adequate police protection while surveying the property comprised in SNo.105/6B1 measuring to an extent of 0.20.0 hectares and SNo.105/5D2 measuring to an extent of 0.10.0 hectares situated at Thorapalli village, Shoolagiri Taluk, Krishnagiri district by considering the petitioner's representation dated 01.02.2025 within a stipulated period.

2. Heard the learned counsel for the petitioner, the learned

Government Advocate (Crl.side) for the first respondent and the learned Special Government Pleader for the respondents 2 to 4 and perused the materials available on record.

3. The petitioner owned property comprised in SNo.105/6B1 measuring to an extent of 0.20.0 hectares situated at Thorapalli village, Shoolagiri Taluk, Krishnagiri district and the petitioner's mother owned property comprised in SNo.105/5D2 measuring to an extent of 0.10.0 hectares situated at Thorapalli village, Shoolagiri Taluk, Krishnagiri district. In order to survey the said properties, the petitioner submitted an application to survey the properties along with the requisite fees. The surveyor visited the property to conduct the survey. While conducting survey, the respondents 4 to 6 herein objected and prevented the surveyor from surveying the property. In this regard, the petitioner had already gave a representation dated 01.02.2025 and the same has not been considered. Hence, this writ petition.

4. Considering the facts and circumstances of the case, if any surveyor is engaged by the revenue authority to survey the petitioner's

land and if the surveyor finds any difficulties while surveying the petitioner's land, he can very well seek police protection before the first respondent. On receipt of such request, the first respondent is directed to conduct enquiry, after issuance of notice to the petitioner and the respondents 4 to 6 herein and pass appropriate orders to provide adequate police protection while surveying the petitioner's land.

5. With the above directions, this Writ Petition petition is disposed of. No costs.
