PRAYER: Writ Petition filed under Article 226 of the Constitution praying to issue a Writ of Mandamus, directing the 1st respondent to transfer the investigation of the case in Crime No.13 of 2023 dated 02.12.2023 pending on the file of the 8th respondent to the file of the 6th respondent (CBI).

O R D E R

This writ petition has been filed for a direction, directing the 1st respondent to transfer the investigation of the case in Crime No.13 of 2023 dated 02.12.2023 pending on the file of the 8th respondent to the file of the 6th respondent (CBI).

2. The learned Additional Public Prosecutor (Pondicherry), appearing for the respondents, on instructions, would submit that after registration of FIR in Crime No.13 of 2023, so far arrested 7 accused were arrested. Two of the accused persons had obtained anticipatory bail. One accused is absconding and so far not yet arrested. That apart, the entire investigation has already been completed by the 8th respondent. 2/4

3. In view of the above submissions, this Court is not inclined to transfer the investigation in Crime No.13 of 2023 from the file of the 8th respondent. However, the 8th respondent is directed to complete the investigation and file a final report within a period of twelve(12) weeks from the date of receipt of a copy of this order. The 5th respondent is directed to monitor the investigation done by the 8th respondent.

4. With the above directions, this writ petition stands disposed of. There shall be no order as to costs.
