O R D E R

When it was pointed out that the impugned order is only recommendatory in nature and that if any action in pursuance thereof is taken, the Petitioner could work out his remedy for necessary relief before the concerned forum in the manner recognized by law in this regard, Learned Counsel for the Petitioner seeks permission of this Court to withdraw this Writ Petition with liberty to resort to the same and he has made an endorsement to that effect.

Recording the same, the Writ Petition is dismissed as withdrawn granting such liberty. It is needless to add here that no view has been expressed by this Court on the correctness or otherwise of the order impugned in this Writ Petition in this Writ Petition and that if such question arises for consideration in subsequent proceedings at the instance of any of the parties, the adjudicating authority shall not be influenced or inhibited by the withdrawal of this Writ Petition. Consequently, connected Miscellaneous Petition is closed. No costs.
