The civil revision petition has been filed for a direction to the Learned District Munsif Court at Mettupalayam, to dispose of O.S.No.12 of 2022, within a time framed fixed instead of granting periodical

adjournments.

2. The case of the petitioners is that they are the defendants in O.S.No.12 of 2022 filed by the respondents seeking for a permanent injunction. The Trial Court in IA No.2 of 2022 had granted an order of interim injunction. The petitioners had entered appearance and filed a vakalat and counter along with counter claim, seeking for a declaration on 23.08.2023.

3. It is the grievance of the petitioners that despite the filing of the counter and counter claim on 23.08.2023, there is no progress in trial and that the plaintiffs are enjoying the benefit of the interim order and thereby the present civil revision petition has been filed seeking for a direction to the trial court to dispose of the suit, within a time frame fixed.

4. Heard the counsel and perused the materials available on record.

5. Having heard the petitioners and perused the materials available on record, a direction is issued to the Learned District Munsif Court, Mettupalayam, to dispose of the suit in O.S.No.12 of 2022, within eight months from the next date of hearing.

6. The civil revision petition stands disposed of. There shall be no order as to costs.
