PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C. praying to direct the 3rd respondent police to provide adequate police protection which will enable the petitioner to carry out the work as per the order dated 06.05.2020 passed by the RDO, Thondamuthur in Na.Ka.No.261/2020/AA3 in a peaceful manner.

ORDER

This petition has been filed seeking for police protection to the petitioner while laying water line around his

property at Ikkaraipoluvampatti, Devarayapuram and Thondamuthur Village, by considering the representation of the petitioner herein dated 18.06.2020.

2. The learned counsel for the petitioner would submit that the petitioner has an agricultural land in Ikkaraipoluvampatti Village and he had approached the officials seeking permission to lay pipes and draw water from Ikkaraipoluvampatti Village to the nearby areas and that he also obtained permission from the RDO, Thondamuthur, vide Na.Ka.No.261/2020/AA3 dated 06.05.2020. However, some persons objected the same and not permitted the petitioner to carry out the work of laying pipe line. Therefore, the petitioner by his representation dated 18.06.2020, sought for police protection from the third respondent. After receipt of the same, the third respondent issued CSR.No.134 of 2020 and thereafter, the third respondent failed to provide any protection to the petitioner and his labourer. Hence, this petition has been filed seeking for appropriate direction.

3. The learned Additional Public Prosecutor appearing for the respondents would submit that the complaint lodged by the petitioner in CSR.No.134 of 2020 is pending for enquiry.

4. Considering the above facts and circumstances of the case, the third respondent is directed to conduct enquiry on the complaint lodged by the petitioner dated 18.06.2020 in CSR.No.134 of 2020 based on the order passed by the RDO dated 06.05.2020 after giving notice to the counter parties and pass orders on merits within a period of two weeks from the date of receipt of a copy of this order. Accordingly, this Criminal Original Petition is disposed of.
