2. A sum of Rs.26,50,000/-(Rupees Twenty Six Lakhs Fifty Thousand Only) has already been paid by the respondent to the appellant as full and final settlement. Therefore, nothing survives for consideration in this appeal.

3. The Memorandum of Compromise is recorded and the first appeal is dismissed as settled out of court. Registry is directed to refund the court fee, as per Rules.
