ORDER

The petitioner, who was arrested and remanded to judicial custody on 17.02.2026 for the alleged offences under Sections 296(b), 115(2), 118(1), 109, 351(3) of the Bharatiya Nyaya Sanhita, 2023, (294(b), 323, 324, 307, 506(ii) of Indian Penal Code, 1860) in Crime No.15 of 2026 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner/accused abused the defacto complainant in filthy language, assaulted him with a knife and criminally intimidated him with dire consequences. Hence, the case was registered.

3. The learned counsel appearing for the petitioner submitted that the petitioner is innocent and has been falsely implicated in this case. The learned counsel would further submit that the petitioner has no connection with the alleged offence and the case has been foisted due to previous enmity. It is also submitted that the petitioner is ready to cooperate with the investigation and will not abscond or tamper with witnesses. Hence, he prayed for granting bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent submitted that the present bail application is filed without any change in circumstances from the earlier application. It is further submitted that the earlier bail petition filed by the petitioner was dismissed on 05.03.2026 in Crl.O.P.No.5709 of 2026. Hence, he strongly opposed the grant of bail to the petitioner.

5. I have given anxious consideration to the submissions made by the learned counsel on either side.

6. Considering the submission of the learned counsel on either side, it is seen that the earlier bail application filed by the petitioner was dismissed on 05.03.2025 in Crl.O.P.No.5709 of 2026. As there is no change in circumstance and in view of the gravity of the offence, this Court is of the view that the petitioner is not entitled to bail at this stage. Therefore, this Court is not inclined to grant bail to the petitioner.
