ORDER

The petitioner, who was arrested and remanded to judicial custody on 18.02.2024 for the alleged offences under Sections 8(c) read with 20(b)(ii)(C), 28 and 29 of NDPS Act in F.No.48/1/05/2024-NCB/MDS on the file of the respondent police, seeks bail.

2. The case of the prosecution is that based on a secret information with regard to the illegal transportation of Ganja, on 18.02.2024, when the respondent police intercepted the vehicle bearing Registration No.TN25 CE 355 and conducted a search, found the accused in the illegal possession of 272 kgs of Ganja and hence the case.

3. There is no representation on behalf of the petitioner.

4. The learned Special Public Prosecutor appearing for the respondent police would submit that quantity of contraband involved in this case is a commercial quantity and therefore, he strongly objected the bail application.

5. I have given anxious consideration to the submissions made by the learned counsel on either side.

6. From the submissions made by the learned Special Public Prosecutor, it is clear that this is a case, where 272 kgs of Ganja has been recovered, which is a commercial quantity. Hence rigors under Section 37 of NDPS Act would attract and there are no materials to overcome the same and therefore, this Court is not inclined to enlarge the petitioner on bail.

7. Accordingly, this Criminal Original Petition is dismissed. 05-06-2026 MJS Note:
