ORDER

The petitioners, who were arrested and remanded to judicial custody on 26.12.2025 for the alleged offence under Section 87, 351(2) BNS, Section 5(l), 5(j)(ii) r/w 6 of POCSO Act 2012 in Crime No.100 of 2025 on the file of the respondent police, seek bail.

2. The case of the prosecution is that the petitioners had committed sexual assault on the victim girl, due to which she became pregnant. Hence, this case.

3. The learned counsel for the petitioner submitted that the petitioners have been incarcerated since 26.12.2025 and it was only an adolescent relationship between them. He further submitted that the petitioners are ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prays for grant of bail to the Petitioners.

4. Per contra, the learned Government Advocate (Criminal Side) appearing for the Respondent Police reiterated the prosecution case and produced the statement recorded from the victim girl by the learned Judicial Magistrate, Omalur dated 23.01.2026 under section 183(5) of BNSS against the petitioners. Hence, he opposed the grant of bail to the Petitioners.

5. I have given my anxious consideration to either side submissions and perused the materials available on record.

6. From the submissions made by the learned counsel on either side and considering the statement recorded under 183(5) of BNSS, it is evident that the victim has raised serious allegations against these petitioners and this is a case

of gang sexual assault against the victim. Considering the gravity of allegations against the petitioners and the involvement of these petitioners in forcible manner, this Court is not inclined to enlarge the petitioners on bail. Hence, this Criminal Original Petition is dismissed.
