The petitioner, who apprehends arrest at the hands of the respondent police for the offence punishable under Sections 328 of I.P.C and Section 20(1) of Cigarettes and other Tobacco Products Act, 2003 in Crime No.199 of 2022 , seeks anticipatory bail. 2.The case of the prosecution is that the petitioner along with other accused was in illegal possession of 1714 kgs of banned tobacco products worth about Rs.25,00,000/- Hence the case.
3. The learned Counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. Hence he prays to grant anticipatory bail to the petitioner
4. The learned Government Advocate would submits that the petitioner is the owner of the vehicle and he was found in possession of
1714 kgs of banned tobacco products worth about Rs.25,00,0000/-. He would further submit that there is also one previous case pending against the petitioner. He also submits that the earlier application filed by the petitioner in Crl.O.P.No.23736 of 2022 as dismissed by this Court on 12.10.2022.
5.Considering the facts and circumstances of the case and the submissions made by both counsel and the previous bad antecedent of the petitioner and the large quantity involved in this case and there is no change in circumstances, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly this petition stands dismissed. 18.04.2023 smn
