This Criminal Original Petition is filed to quash the F.I.R., in Crime No.96 of 2023 on the file of the 1st respondent police. 2.

The case of the petitioner is that the complainant in Crime No.96 of 2023 is the real perpetrator of the crime and the complaint been given by the petitioner herein against him registered in Crime No.96 of 2023 is under investigation.

The learned Government Advocate (Crl.Side) appearing for the respondent police states that on 30.07.2023, a complaint and counter complaint been given alleging that there is a misappropriation of fund collected for construction the temple and also encroached the property of the temple. The counter complaint by the petitioner herein alleging that his property been damaged. Both the cases are under investigation. He further states that investigation is almost completed and final report will be filed within 30 days.
