ORDER : The Court Made the following order :- The petitioner, who was arrested and remanded to judicial custody on on 07.03.2021 for the alleged offences punishable under Sections 174(3) of Cr.P.c and altered to Sections 120(b), 302,201 of I.P.C in Crime No.436 of 2019, on the file of the respondent police, seeks bail.

2.The case of the prosecution is that due to previous enmity the petitioner waylaid the deceased and tied his legs and hands and assaulted him with knife and he died on the spot itself. Hence the complaint.

3.The learned counsel appearing for the petitioner would submit that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case.

4.The learned Additional Public Prosecutor would submit that the petitioner has assaulted the deceased with knife, due to which the deceased died on the spot itself. Hence she vehemently oppose to grant bail to the petitioner.

5.Considering the fact that the petitioner brutally assaulted the deceased and caused injuries to him and the deceased succumbed to the injuries on the spot itself, this Court is not inclined to grant bail to the petitioner.

6.Accordingly, this criminal original petition is dismissed. -sd/- 28/04/2021 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.) High Court, Madras - 600 104.
