The petitioner, who was arrested and remanded to judicial custody on 04.03.2024 in Crime No.172 of 2024 registered for the alleged offences punishable under Sections 341, 294(b), 323, 324, 307 of IPC, seeks bail.

2. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He also submitted that the petitioner is suffering incarceration from 04.03.2024 and he is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

3. Learned Government Advocate (Criminal Side) appearing for the respondent police raised objection for granting bail stating that during the quarrel with regard to grazing of cow, the petitioner had abused and assaulted the father of the de facto complainant with iron rod, due to which, he sustained grievous injuries and also lost his three teeth. He further submitted that the injured has been discharged from the hospital and the investigation is still pending. He also submitted that the petitioner is a habitual offender, against whom, 23 previous cases are pending. Taking into consideration the facts and circumstances of this case and the submissions made by the learned Government Advocate (Criminal Side) and taking note of the fact that the investigation is at initial stage and also considering the previous antecedents of the petitioner, this Court is not inclined to grant bail to the petitioner.
