C.M.P.No.9365 of 2019 in S.A.SR No.70306 of 2017 V.BHARATHIDASAN.J., This miscellaneous petition is filed seeking to accept the cause title by impleading (1) S.Gowri, (2) S.Ramesh, (3) S.Jayalakshmi and

(4) S.Nagarajan, who are the legal representative of the deceaed sole appellant-T.Sadasivam, as appellants 1 to 4 respectively in the second appeal.

2. According to the petitioners, subsequent to the disposal of the appeal suit, the sole appellant died on 19.11.2017 and being legal representatives of the deceased appellant, they are entitled to prefer a further appeal as against the judgement of the first appellate court and therefore, this petition.

3. Considering the fact that the sole appellant died only subsequent to the judgement in the appeal suit and the other facts and circumstances of the case, this court is inclined to allow this miscellaneous petition.

4. In the result, this miscellaneous petition is allowed and the cause title impleading the petitioners as legal representatives of the deceased appellant in the second appeal is accepted and the Registry is directed to number the second appeal if the papers are otherwise in order.
