Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorari to call for the records passed by the Labour Court, Cuddalore in I.D.No. 11/2021 dated 27.09.2022 and to quash the same as illegal.

ORDER

Challenging the order passed in I.D.No.11 of 2021 dated 27.09.2022, the petitioner-Management is before this Court. 1/4

2. The respondent was appointed as a Driver-cum-Conductor in the Tamil Nadu State Express Transport Corporation on temporary basis on 27.10.2012. Thereafter, he was transferred to the petitionerCorporation. On account of his frequently taking unauthorized leave, particularly between the period from 04.05.2015 to 20.05.2019, the respondent was discharged from service. The respondent had raised an Industrial Dispute in I.D.No.11 of 2021 challenging his termination, which is totally against the principles of natural justice.

3. The Labour Court, Cuddalore, by its order dated 27.09.2022, had ordered reinstatement with continuity of service and 25% back wages from the date of termination till the date of reinstatement. The Labour Court had made it clear that the respondent would not be entitled to any other benefits.

4. Today when the matter is called, it has been brought to the notice of this Court that the respondent has been reinstated into service on 10.02.2023 and continues to remain in service. 2/4

5. Therefore, in view of the reinstatement of the respondent into service on 10.02.2023, the continuance of this Writ Petition has become redundant. Accordingly, this Writ Petition is dismissed.
