Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondents 1 to 3 to consider and promote the petitioner to the post of Executive Engineer with effect from 22.09.2009 with all backwages, monetary benefits and seniority. O R D E R

The relief sought for in this writ petition is to direct the respondents 1 to 3 to consider the representation submitted by the writ petitioner and to promote the petitioner to the post of Executive Engineer with effect from 22.09.2009 with all monetary and other consequential benefits.

2.The writ petitioner is now working as Assistant Engineer and his next avenue of promotion is Executive Engineer. The https://hcservices.ecourts.gov.in/hcservices/

learned counsel appearing on behalf of the writ petitioner submits that the writ petitioner is failed to qualify for the post of Executive Engineer and in this regard, the writ petitioner has submitted a representation on 20.02.2015 to the 1st respondent to grant relaxation. However, the representation is yet to be considered by the 1st respondent. Thus, without going into the merits of the case, the 1st respondent is directed to consider the representation submitted by the writ petitioner on 20th February 2015 and pass orders on merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order. The writ petitioner is directed to enclose a copy of the representation along with the order passed in this writ petition.
