Prayer: Writ petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus to direct the respondents to forthwith take action to issue work order being the successful bidder, towards the outsourcing for operation and maintenance of CWSS to 79 coastal habitations, 17 Town and 19 wayside villages in Kanyakumari Distirct for the year 2017-18, based on the representation dated 21.07.2017. This writ petition is filed for a mandamus directing the respondents to forthwith issue work order to the petitioner, being the successful bidder in respect of the subject matter contract.

2. After notice, this matter is taken up for further hearing. The respondents filed ahe counter affidavit and also the typed set of papers wherein it is seen that already an order dated 11.07.2017 was passed by the Superintendent Engineer, TWAD Board, Tirunelveli - Kanyakumri Circle, rejecting the petitioner's tender as invalid.

3. When such being the factual position, it is for the petitioner to work out his remedy by challenging the said order in a manner known to law. Consequently, this prayer, as such, cannot be maintained. Therefore, this Writ petition is disposed of without expressing any view on the merits of the matter, only by granting liberty to the petitioner to challenge the said order dated 11.07.2017 in accordance with law.
