ORDER

This writ petition has been filed seeking for a direction to first respondent to make a reference in Award dated 29.07.2022 vide Na.Ka.No.235/2019/A1(SH-23) to the appropriate authority for the determination of enhancement of the compensation and other remedies by considering the petitioner's representation dated 24.06.2022 and a subsequent reminder dated 09.11.2022.

2. Heard learned counsel for the petitioner and the learned Additional Government Pleader appearing for the respondents and perused the materials available on record.

3. The petitioner's land was acquired under Section 15(1) of the Tamil Nadu Highways Act 2001 and the award was passed under Section 19(5) of the Act. It is the case of the petitioner that the second respondent fixed the value at 33.15 per sq.mt., the same was objected. In this regard, representation is given to the first respondent to refer the matter to the appropriate authority, however, the same has not been considered.

4. Such view of the matter, the first respondent is directed to consider the representation of the petitioner and make reference to the appropriate authority within a period one one month from the date of receipt of a copy of this Order.

5. Accordingly, this writ petition stands disposed of.
