Respondent PRAYER: This Criminal Original Petition filed under section 439(1)(b) of Cr.P.C., seeking to modify the condition imposed by the learned Principal District and Sessions Judge, Erode that the petitioner shall report before the Court concerned viz., the Judicial Magistrate-II Court, Bhavani daily once at 10.30 a.m., for a period of 30 days.

O R D E R

(The case has been heard through video conference) . This petition has been filed seeking to modify the condition imposed by the learned Principal District and Sessions Judge, Erode, directing the petitioner to report before the Court concerned namely Judicial Magistrate No.II Court, Bhavani, daily once at 10.30 a.m., for a period of 30 days.

2. The learned counsel for the petitioner would submit that due to COVID-19 pandemic, the petitioner is unable to appear before the Judicial Magistrate No.II Court, Bhavani, as per the condition imposed by the Learned Principal District and Sessions Judge, Erode.

3. Taking into consideration the COVID-19 Pandemic, the condition to report before the Judicial Magistrate No.II, Bhavani daily at 10.30am for a period of 30days is modified and in the alternate the petitioner is directed to report before the respondent/police as and when required.
