J U D G M E N T
(Judgment of the Court was delivered by R.SUBRAMANIAN, J.) Challenge is to the order of the writ Court dated 06.10.2023 made in W.P.No.18731 of 2021.
2. The claim of the respondent for compassionate appointment was rejected by the Electricity Board mainly on the ground that the application was barred by time. On an earlier occasion, the respondent filed W.P.No.31399 of 2014 as against the order of rejection. This Court vide order dated 05.01.2021 found that the application was in time and directed the respondent to pass orders afresh. The second rejection order which was impugned in the Writ Petition was on the same ground. We therefore see no 2/5
merit in the appeal and the order impugned in this Writ Appeal does not call for interference.
3. Hence, the Writ Appeal is dismissed. No costs. Consequently, the connected miscellaneous petition is closed.
4. Mr.K.Rajkumar, learned counsel appearing for the appellants has also produced the order of the Chief Engineer/ Personnel offering compassionate appointment to the respondent. The same is also recorded. Since we have dismissed the appeal on the ground that the earlier order has become final, this order will not serve as a precedent. (R.S.M.,J.)
