The petitioner/plaintiff has filed a suit in O.S.No.1 of 2011, on the file of the III Additional District and Sessions Court, Kallakurichi for Specific Performance against the respondent herein.

2. The aforesaid suit was numbered and transferred to the file of the Subordinate Court, Kallakurichi and re-numbered as O.S.No.1 of 2011, no interim application pending before the Court below. The Court below has wrongly misunderstood that the interim application is pending before the Court below. Therefore, there is no legal impediment to dispose the suit within a time frame by this Court.

3. Accordingly, this Civil Revision Petition is disposed of. The III Additional District and Sessions Court, Kallakurichi is directed to dispose the O.S.No.1 of 2011 case as expeditiously as possible preferably within a period of 4 months from the date of receipt of a copy of this order. No costs. Consequently, connected Miscellaneous Petition is closed.
