ORDER

The petition has been filed to quash the proceedings in Se.Mu.Aa. No. P1/ 1005/ 2025 dated 27.01.2026 on the file of the respondent herein and consequently direct the respondent to restore the petitioner to duty with all attendant benefits.

2. It is the case of the petitioner that he was working as Seasonal Bill Clerk in the respondent Corporation since 2014. On 19.03.2025, during a surprise inspection, the petitioner was found involved in the malpractices and a shortage of 322 bags of paddy was deducted and subsequently, he was relieved from service on 02.04.2025. Later, a show cause notice dated 11.04.2025 was issued to the petitioner, for which, he had sent a detailed explanation denying the allegations. However, without conducting any enquiry, impugned proceedings dated 27.01.2026 was passed confirming the dismissal order of the petitioner. Aggrieved by the same, the petitioner is before this Court.

3. Heard the rival submissions and perused the materials available on record.

Therefore, without going into the merits of the case, considering the fact that the orders have been passed by the respondent without issuing charge memo to the petitioner and hearing him, the impugned order is set aside and the matter is remitted back to the respondent for a fresh consideration. Since the petitioner has already submitted his explanation, the respondent is directed to afford an opportunity of personal hearing to the petitioner and thereafter, pass the speaking orders. The said exercise

shall be completed by the second respondent within a period of four weeks from the date of receipt of a copy of this order. With the above directions, this writ petition is disposed of. Consequently, connected miscellaneous petitions stand closed.
