..Respondent(s) Writ petition filed under Article 226 of Constitution of India for the issuance of writ of Certiorarified Mandamus to call for the records relating to the land acquisition order issued by the 1st respondent in G.O.(Ms) No.75 Industries (SIPCOT-LA) Department dated 08.07.2024 and the consequential order bearing No.CLA-SIP/ 2026/ 69/ 01/ 07/ 0001 dated 06.01.2026 passed by the 2nd respondent under Section 3(3) of the Tamil Nadu Acquisition of Land for Industrial Purposes Act, 1997 and quash the same insofar as the petitioners land comprised in S.F. Nos.895/3, 900/4, 898/4, 899/4, 899/2 and 899/3 situated in Pudupatti village, Mohanur Taluk, Namakkal District and consequently, direct the respondents to re-align the proposed acquisition area by excluding the petitioners industrial land.

ORDER

This writ petition has been filed challenging the impugned proceedings of the 2nd respondent dated 06.01.2026, issued under Section 3(3) of the Tamil Nadu Acquisition of Land for Industrial Purposes Act, 1997 (hereinafter referred to as the "Act), whereby the petitioner's request for providing alternative land in lieu of the land proposed to be acquired has been rejected.

The petitioner claims that they are running a stone crushing unit and an M-sand production unit in the subject property, which is proposed to be acquired. The said property is also the subject matter of the impugned proceedings of the 2nd respondent dated 06.01.2026 passed under Section 3(3) of the Act.

The learned counsel for the petitioner submitted that despite the petitioner undertaking to exchange the subject land with alternative lands owned by them in the vicinity of the proposed project, the 2nd respondent rejected the request without giving due consideration. The learned counsel further

submitted that the final order of acquisition, as per the provisions of Section 3(1) of the Act, acquiring the lands of the petitioner is yet to be passed. The learned counsel further submitted that only the procedure contemplated under Section 3(2) and Section 3(3)of the Act alone has been fulfilled by the respondents. Therefore, the learned counsel submitted that before the final acquisition order is passed, the petitioner's request for exchange of lands in lieu of the lands proposed to be acquired from the petitioner can be considered by the respondents.

No prejudice will be caused to the respondents, if the petitioner is allowed to submit a representation to the respondents requesting them to reconsider the impugned proceedings, after giving an opportunity for the petitioner to convince the respondents that the alternative lands to be provided by the petitioner will fully satisfy the requirements of the respondents in setting up the SIPCOT industrial project in lieu of the lands belonging to the petitioner which has been proposed to be acquired by the respondents, as seen from the impugned proceedings of the 2nd respondent dated 08.07.2024. 5.

The learned counsel appearing for the respective respondents have also not raised any serious objections with regard to the petitioner's request for reconsideration of the impugned proceedings.

This Court is not expressing any merit on the respective contentions.

For the foregoing reasons, this writ petition is disposed of by directing the petitioner to submit a fresh representation to the 3rd respondent seeking for reconsideration of the impugned proceedings dated 08.07.2024 passed by the 2nd respondent by offering alternative lands situated in the same vicinity of the SIPCOT industrial project, which according to the petitioner are owned by them in lieu of the lands which are the subject matter of the proposed acquisition and which are the subject matter of the impugned proceedings, within a period of two weeks from the date of receipt of a copy of this order.

On receipt of the said representation within the time stipulated, the 3rd respondent shall pass a final order on the petitioner's request for reconsideration of the impugned proceedings, after affording one opportunity of personal hearing to the petitioner's authorised representative, as stated supra, within a period of four weeks thereafter. Before passing the final order, the 2nd respondent shall consult the 7th respondent. No costs. Consequently, the connected miscellaneous petitions are closed.
