ORDER

The petitioner herein is the complainant before the Assistant Commissioner of Police seeking enquiry regarding the alleged attempt by one Mr.Jeyendira Natwarlal Vora of Mumbai and others to grab the family property of the petitioner by fraudulent means stating that the police has not investigated the complaint, the present petition is filed seeking direction to enquire the matter in accordance with law.

The learned Government Advocate (Crl.Side) submits that the complaint of the petitioner was taken up for enquiry and after enquiry found that the civil dispute regarding the title and therefore, the parties are advised to work out their remedy before the Civil Court and the complaint been closed as " mistake of fact" on 31.07.2023.

3. The learned counsel appearing for the petitioner submits that the closure report not served to the defacto complainant. If it is so, the respondent police shall serve copy of the closure report to the defacto complainant and on receipt of the closure report can proceed in accordance with law.

4. With the above direction, this writ petition is disposed of. No order as to costs.
